Aleema Khan’s Request Heard by IHC

Justice Khadim Hussain Soomro heard Aleema Khan’s request and advised her to get permission from the trial court before traveling abroad. Court Sides with Raoof Hasan

Justice Inam Amin Minhas, in a distinct ruling, sided with Raoof Hasan, declaring the inclusion of his name on the Passport Control List (PCL) as both unlawful and carried out with bad intentions.

The court ordered that Hasan’s name be removed from the Passport Control List (PCL) and advised him to get approval from the trial court before traveling abroad.

Hasan’s lawyer explained that, as a cancer survivor, he needs regular medical check-ups in the UK every six months. The lawyer argued that placing him on the Passport Control List (PCL) was unjustified and lacked any solid reason.

The court highlighted that Hasan remains on bail in a case under the Federal Investigation Agency (FIA), with no action from the state to challenge or cancel his bail.

The Islamabad High Court (IHC) pointed out flaws in the process, noting that the Federal Investigation Agency (FIA) had suggested Hasan’s name for the Prohibited Citizens List (PCL) on July 24, 2024.

However, the Director General of Immigration and Passports included his name on the list on August 26 without obtaining prior approval from the federal government.

The court found that placing someone on the Prohibited Citizens List (PCL) merely because of a pending criminal investigation or case isn’t in line with the Passport Rules. These rules give the federal government sole responsibility for managing the movement of people in and out of the country.

It’s important to point out that Raoof Hasan spent a total of seven days in FIA custody for the Peca case. This included a two-day physical remand, followed by a three-day extension, and then an additional two-day extension for further investigation.

After his 14-day remand ended, he was transferred to Adiala Jail. However, on the same day, he was also arrested in a separate terrorism case.
